These Terms & Conditions ("Terms") set out the basis on which E-TOURS ONLINE BOOKING LIMITED ("E-Tours", "we", "us", "our") provides travel-related services to you via www.etours.ie (the "Website"). By making a booking, you agree that these Terms (together with any supplier/organiser terms shown to you before booking) form your contract.

1) Who we are & our role

E-TOURS ONLINE BOOKING LIMITED (company no. 783730); registered address: 93 Marlborough Street, Dublin, D01 X2W6, Ireland. We operate an online platform for booking travel services. Depending on what you purchase, we may act as:

  • Agent for the underlying supplier (e.g., airline, hotel, car hire, event organiser), in which case your contract is with that supplier and their terms apply; or
  • Organiser of a package under EU Package Travel rules, where we combine at least two different types of travel services for the same trip (e.g., flight + hotel) sold at an inclusive/total price (including dynamically-built "click-through" packages).

Where we act as organiser, your rights under Directive (EU) 2015/2302 and S.I. No. 80/2019 apply; where we act only as agent, the relevant supplier is responsible for performance subject to its terms.

2) Definitions

Package: a combination of at least two different travel services (e.g., transport, accommodation, car rental, or other tourist services) for the same trip, sold at an inclusive/total price or as per the Directive's broadened definitions (including many dynamic/click-through scenarios).

Unavoidable and extraordinary circumstances: events beyond a party's control, the consequences of which could not have been avoided even if all reasonable measures had been taken (e.g., serious security risks, major weather events).

3) Contract formation

A booking is confirmed when you receive our confirmation on a durable medium (usually email). Please check all details (names exactly as on passports, dates, itinerary) and notify us immediately of any errors. Where we are agent, we convey the supplier's acceptance and issue their confirmation/ticket(s).

4) Prices, fees & payment

  • Prices may change until confirmed/paid due to supplier availability, exchange rates, or tax/fee changes.
  • Payment is due as shown at checkout/confirmation. Failure to pay on time may result in cancellation by the supplier or by us on the supplier's instructions.
  • Card charges: We do not impose unlawful surcharges for card payments; EU rules restrict excessive payment surcharges.
  • Obvious errors: We reserve the right to correct obvious pricing/description errors promptly and offer you the choice to continue at the correct price or cancel with a full refund.

5) If you change or cancel (non-package bookings)

For agent-only bookings (e.g., flight-only, hotel-only), your right to change/cancel depends on the supplier's fare/rate rules. Many airline tickets/accommodation rates are non-refundable/non-changeable or carry fees; any permitted changes also attract our reasonable admin fee (shown before you confirm). There is no general 14-day cooling-off right for passenger transport, and package travel has its own regime (see #7).

6) If the supplier changes or cancels (non-package bookings)

Where we act as agent, we'll notify you of supplier-initiated changes/cancellations and assist with the options the supplier offers (e.g., rebooking, refund, credit). Rights vary by supplier and product type. For flights operated to/from/within the EU, Air Passenger Rights (EC 261/2004) may apply; claims are made against the airline, not E-Tours.

7) Packages & Linked Travel Arrangements (when we are organiser/facilitator)

7.1 Your key rights for packages
  • Responsibility for performance: We are responsible for the proper performance of all travel services in the package, regardless of who supplies them.
  • Pre-contract information & standard forms in clear language before you book.
  • Price changes: Only if expressly allowed and strictly defined cost changes apply (e.g., fuel, taxes, exchange rates) with the right to a price reduction for cost decreases. No increase permitted in the last 20 days before departure.
  • Transfer: You may transfer the package to another person who meets the conditions of the trip, on reasonable notice and payment of actual transfer costs.
  • Termination before start: You may terminate by paying a reasonable termination fee. You can also terminate without a fee where unavoidable and extraordinary circumstances at the destination significantly affect the trip.
  • Lack of conformity: If a significant proportion of services cannot be provided as agreed, we will offer suitable alternatives at no extra cost; you may be entitled to a price reduction and compensation.
  • Insolvency protection ensuring refunds and, if necessary, repatriation; administered in Ireland under the IAA regime.
7.2 Linked Travel Arrangements (LTAs)

If we facilitate an LTA, you will receive information on which protections apply (fewer than for packages). We provide insolvency protection only for the travel service we sell/facilitate where required by law.

8) Flights, air passenger rights & liability limits

Air Passenger Rights (EC 261/2004): For eligible EU flights, the operating airline must provide assistance and, where applicable, compensation in cases of long delays, cancellations, or denied boarding. Claims are made directly to the airline.
Montreal Convention: For international carriage by air, the airline's liability for passenger injury/death, baggage and delay is governed by the Montreal Convention and EU law applying it to EU carriers (tiered liability, limits, and time limits).

9) Passports, visas, health & travel advice

You are responsible for meeting entry/visa requirements, passport validity, vaccinations, health/insurance certificates, and complying with airline/security rules. We strongly recommend you check official government sources well before departure and take out comprehensive travel insurance that matches your needs.

10) Travel insurance

Unless stated otherwise, insurance is not included. Many suppliers require proof of adequate cover (e.g., medical, cancellation, supplier failure). It's your responsibility to ensure the policy suits your circumstances, including any pre-existing conditions.

11) Special requests, reduced mobility & assistance

Tell us about any special requests or reduced mobility/access needs before booking. We'll pass requests to suppliers but cannot guarantee them unless confirmed in writing. If reasonable adjustments are needed, we'll liaise with suppliers consistent with applicable EU rules.

12) Supplier rules, conduct & check-in

You must comply with all supplier conditions (e.g., minimum check-in/reporting times, baggage rules, accommodation policies). Suppliers may refuse service if you are unfit to travel, present a safety risk, or breach their rules.

13) Our liability (agent vs organiser)

Agent-only bookings: Our liability is limited to losses directly caused by our own negligence. We are not responsible for acts/omissions of suppliers or events outside our control; your rights are under the supplier's terms and applicable law.
Packages (organiser): We are liable for the proper performance of the package as set out at #7, subject to the Package Travel framework and applicable international conventions (e.g., Montreal for air).

14) Force majeure / Unavoidable & extraordinary circumstances

Neither we nor suppliers are liable for failure to perform or for changes caused by events beyond reasonable control (e.g., war/terrorism, epidemics, severe weather, air traffic control restrictions, industrial action, significant utility outages). Package traveller rights in such situations are as per Directive (EU) 2015/2302.

15) Complaints & assistance

During travel: If something goes wrong, tell the relevant supplier and us as soon as possible so we can try to resolve it.
After travel: Please submit a detailed complaint within a reasonable time with supporting evidence.
ADR / ODR: The EU Online Dispute Resolution (ODR) platform has been permanently discontinued (20 July 2025); traders are no longer required to provide an ODR link. We will consider appropriate Alternative Dispute Resolution options, but this does not affect your right to bring proceedings in the courts of Ireland.

16) Data protection

We process personal data as described in our Privacy Policy. This includes sharing data with suppliers for booking fulfilment and, where relevant, with authorities as required by law.

17) Website content & intellectual property

Website content is provided in good faith. Images/amenities are illustrative and may vary by date/provider. All intellectual property on the Website (text, graphics, logos) is owned by or licensed to E-Tours.

18) Governing law & jurisdiction

These Terms are governed by the laws of Ireland, and the Irish courts have exclusive jurisdiction, without prejudice to mandatory consumer protections that cannot be excluded under EU law.

Annex A - Package Travel: Summary of standard rights (when E-Tours is organiser)

  • Full information before the package contract is concluded; standard information forms used.
  • One point of responsibility (the organiser) for proper performance of all included services.
  • Emergency contact and assistance when difficulties arise.
  • Reassignment/alternatives if key elements cannot be provided as agreed, with price reduction and compensation where appropriate.
  • Insolvency protection covering refunds and repatriation (administered in Ireland via IAA).
  • Termination rights: reasonable termination fee; no-fee termination if unavoidable/extraordinary circumstances occur at the destination.
  • Price change limits and transparency (reductions and increases; time-limit on increases).
